Welcome to the National Medspa Association (NATIONALMSA.ORG). The NATIONALMSA.ORG website (the “Site”) is comprised of various web pages operated by National Med Spa Association (“NMSA”). NATIONALMSA.ORG is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”).
Your use of NATIONALMSA.ORG constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference. NATIONALMSA.ORG is a Licensing and Regulation’s Bureau Site. The National Medspa Association is a Governing entity for Non-Invasive Aesthetic Practitioners and Educators. The department of Licensing & Regulations will collect occupational fees from businesses within the division of Non-Invasive Aesthetics.
New businesses and established unauthorized operators must obtain their NMSA Occupational License one month prior to opening their business or upon receipt of acceptance NMSA Membership & Accreditation. Each of the 50 states has their own medical practice act that dictates the Regulations for medical spa practices. It can be confusing and hard to consistently comply with these regulations, but it is worth it for a medical spa owner and employee to be ahead of the game and stay abreast of the rules and regulations. Membership Agreement
Your membership is a contractual privilege to use the National Medspa Association’s membership portal, accreditation seal, and services.
Your membership does not entitle you to any interest or ownership in the
Association or its property and confers no right to participate in the management or operation of the association. The membership types, the amount of
initiation fees, dues, and other charges payable by the members, the suspension and termination of members, and all other matters affecting or
relating to your membership shall be in the Association’s sole discretion.
Members will comply with all deadlines to prevent possible termination of account without refund. Members also understand the Licensing process time frame will vary depending on submissions of documentation.

NMSA License Data Search provides information about Accredited and licensed individuals for those professions and businesses that are regulated by the Department of Business and Professional Regulation.
Individuals seeking licensing information can do so through our user-friendly, self-service NMSA Open Record Center (ORC) License Directory. All Licensed members must sign a “Public Information Act Policy” at the time of submitting license application.
The Privacy Act of the National Med Spa Association, as amended, 5 U.S.C. § 552a, establishes a code of fair information practices that governs the collection, maintenance, use, and dissemination of information about individuals that is maintained in systems of records by federal agencies.
A system of records is a group of records under the control of an agency from which information is retrieved by the name of the individual or by some identifier assigned to the individual.
The Privacy Act requires that agencies give the public notice of their systems of records by publication in the Federal Register.
The Privacy Act prohibits the disclosure of a record about an individual from a system of records absent the written consent of the individual unless the disclosure is pursuant to one of twelve statutory exceptions. The Act also provides individuals with a means by which to seek access to and amendment of their records and sets forth various agency record-keeping requirements.
Upon membership acceptance, members are agreeing to business listing being published in our database as public records.
Communications
Members understand that communications with us can be done by scheduling a call via our website or by texting our fast response text line (929) 209-1991. All members will be appointed an agent who will be assisting during their duration of membership.
Members must submit business logos to Response text line (929) 209-1991 with-in 30 days to receive Custom Media Kit. The turnaround time will be 3-5 business days after approval of membership.

The National Medspa Association is not responsible for assisting members with obtaining physical business locations, as every state requirement vary. We do understand that this is an important aspect in becoming a business owner. We have included recommendations to enlighten members on what they should do to obtain a physical location.
Understanding State Professional Business Categories:
Most State’s Professional Business Categories consist of Cosmetologist, Estheticians, and Massage Therapist as professional business types.
EXAMPLE:
Are not considered professional categories, which means state officials will not recognize these terms. We have provided a list of ways to bypass this.
3 SIMPLE STEPS
Inspections
The NMSA, shall conduct random inspections of every licensed and unlicensed non-invasive medical spa facility. An inspection report will be forwarded to the provider’s business residing state.
Such inspections shall be repeated within a period no less than two years and no more than four years, or in response to the filing of a complaint with the NMSA.
For each inspection:
1) A representative of (Business State) shall provide proper identification.
2) The owner of a non-invasive medical spa facility shall permit access to all parts of the facility and all pertinent employee records and facility protocols required for inspection.
3) An inspection report shall identify in a narrative form any violations of (this Act/regulation) and shall be cross-referenced to the section of (the Act/regulation) being violated.
4) Results of the inspection shall be made available to the public upon request.
Any person who violates any provisions of (this Act/regulation) or who shall refuse to comply with a lawful order or directive of the National Med Spa Association, shall be liable for monetary Penalties can range between $1,500 and $7,500 per violation.
Repeat violations can cost $75,000.
and all other applicable law and/or injunctive action as provided by law, or both.
The NMSA may revoke, suspend, or deny renewal of a license(s) to operate a Non-invasive medical spa facility for failure to comply with any provision of (this Act/regulation).
The NMSA may revoke, suspend, or take other disciplinary action against the medical license of any medical director or supervising physicians found to be in violation of the requirements of (this Act/regulation).
Mandatory Courses
All members will be required to complete the following mandatory courses prior to submitting Licensing Application. Members who have previously obtained any of the following will not need to retake course if certification is not expired. The following courses are provided by are recognized by the NMSA as Accredited and Approved training provider.

CE CREDIT
Hours of In-Class/ In-Person including:
(8 Hrs In Class = 40 CE Credits)
(16 Hrs Online = 40 CE Credit)
Some courses may provide only 20 credits please visit Educator’s Dashboard to learn more.
Each addition 8/ 16 hrs will be equivalent to 40 CE Credits.
EXAMS
Educators are required to provide students with exams upon completion of training. Students are required to pass exams with a 78% or Higher. Students who fail exams will be responsible for remediation fees which are determined by the training institute, not to exceed the amount of ($150.00 USD)
Students who fail the exam more than twice will result in “Student & Training Provider Evaluation.”
The evaluation process is used to determine if the training curriculum may need to be revised to aid in the academic progress of students.
Educator’s must present students with an NMSA Transcript which can be found on their educator’s portal.

NMSA and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion. Children Under Thirteen NMSA does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use NATIONALMSA.ORG only with permission of a parent or guardian.
Cancellation/Refund Policy US orders:
Due to the sensitivity of our products, and services all sales are final. Returns are not accepted. All Sales are Final on Memberships, Licensing, Accreditations, or any other products or services obtained through the National Med Spa Association! No Refunds will be distributed. International Users
Service is controlled, operated, and administered by NMSA from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. Indemnification
You agree to indemnify, defend and hold harmless NMSA, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. NMSA reserves the right, at its own cost, to assume the exclusive defense and control of any matter.

Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims regarding these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and NMSA agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
Termination/Access Restriction
NMSA reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of New York, and you hereby consent to the exclusive jurisdiction and venue of courts in New York in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. You agree that no joint venture, partnership, employment, or agency relationship exists between you and NMSA as a result of this agreement or use of the Site. NMSA’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of NMSA’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by NMSA with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and NMSA with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and NMSA with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Changes to Terms
NMSA reserves the right, in its sole discretion, to change the Terms under which NATIONALMSA.ORG is offered. The most current version of the Terms will supersede all previous versions. NMSA encourages you to periodically review the Terms to stay informed of our updates.
