1. Acceptance of Terms

By accessing or using the National Medspa Standards Association (“NMSA”) website, platform, or services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Description of Services

NMSA provides private international licensing, accreditation, and certification services for non-invasive aesthetic professionals. Our services include, but are not limited to:

  • Practitioner and educator licensing.
  • Accreditation of aesthetic training programs.
  • Continuing education and mandatory training courses.
  • Trademark and business name protection services.
  • NMSA Protect coverage plans.
  • Compliance resources and regulatory guidance.

3. Eligibility

You must be at least 18 years of age and a qualified aesthetic professional (or applying to become one) to use NMSA licensing services. By using our services, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify NMSA immediately of any unauthorized use of your account.

5. Licensing and Certifications

NMSA licenses and certifications are private, voluntary credentials issued by NMSA as an independent standards body. They do not replace or substitute for any state, federal, or government-issued licenses required by law. Holders of NMSA credentials are responsible for ensuring compliance with all applicable local, state, and federal regulations in their jurisdiction.

6. Fees and Payments

All fees are listed on the applicable service pages. Payments are non-refundable unless otherwise stated. NMSA reserves the right to modify pricing at any time with reasonable notice. Failure to pay required fees may result in suspension or revocation of licenses and credentials.

7. Intellectual Property

All content on the NMSA platform, including logos, course materials, certification designs, and written content, is the exclusive property of NMSA and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent from NMSA.

8. Prohibited Conduct

You agree not to:

  • Misrepresent your credentials, qualifications, or identity.
  • Use NMSA credentials after they have expired or been revoked.
  • Engage in fraudulent activities related to licensing or accreditation.
  • Attempt to access systems or data you are not authorized to access.
  • Reproduce or distribute NMSA course materials without authorization.

9. Disclaimer of Warranties

NMSA services are provided “as is” and “as available” without warranties of any kind, either express or implied. NMSA does not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, NMSA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services. NMSA's total liability for any claim shall not exceed the amount paid by you for the service giving rise to such claim.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.

12. Changes to Terms

NMSA reserves the right to modify these Terms and Conditions at any time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
